By registering with the Producer (Cleveland Oktoberfest), the Registrant hereby agrees to exhibit the vehicle described in the registration at the Cleveland Oktoberfest Car Show, and further agrees to abide by the following terms and conditions:
- The Registrant agrees to comply with all rules, regulations and policies governing the behavior of Cleveland Oktoberfest event attendees, as set forth by the Producer (Cleveland Oktoberfest). Failure to adhere to these rules may result in expulsion from the event.
- The Producer shall have the final authority to determine the location of a Registrant’s display within the show.
- Once a Registrant’s display and/or vehicle is set up, they shall not be removed or concealed by the Registrant prior to the end of the show without permission from the Producer.
- The Registrant, his/her guest, and all friends or members of the Registrant’s family in the exhibit area agree to permit the Producer or its assigns the use of their names/pictures, as well as pictures of the entered vehicle for publicity, advertising and commercial purposes (including newspapers, magazines, radio and television) before, during and after the event, and do hereby relinquish all rights to any photos taken in connection with the event, and release to the Producer or its assigns all right to publish, sell or otherwise dispose of said photographs.
- The Producer, all event sponsors, officers, directors or shareholders thereof, and the event venue (the Cuyahoga County Fairgrounds), shall be held harmless for any and all loss or damage to the Registrant’s personal property, which shall specifically include, but is not limited to, the Registrant’s vehicle, trailer, display, material and/or parts. The Registrant hereby waives any and all rights to seek damages against the aforementioned parties.
- Registrant agrees to assume full responsibility for, and obtain insurance to cover, any potential loss, damage, or injury incurred by the Registrant or the Registrant’s associates. The Registrant concedes that this registration agreement supersedes any and all prior and/or contemporaneous agreements and understandings whether written or oral between Registrant and the Producer, Producer’s employees, show staff, representatives, volunteers and sub-contractors. Nothing herein shall be modified unless consented to by the Producer in writing. Both parties agree that all legal disagreements shall be decided by arbitration in the state where the show is produced. All parties will hold harmless and indemnify Cleveland Oktoberfest, its staff, officers, volunteers, and representatives, as well as the staff, officers, and representatives of the Cuyahoga County Fairgrounds.
- No campaigning or soliciting is allowed, and no commercial advertising is permitted in the exhibit area unless a vendor or sponsorship agreement specifying such rights has first been established with Cleveland Oktoberfest. A single sign may be used to identify significant vehicle customizations, who performed the work, and the tools/parts used, but large poster or sandwich board ads, flyers, for sale signage, or business card distribution is prohibited. All publicity and advertising rights are reserved by the Producer and its assigns.
- The Registrant agrees that his/her email and other contact information may be used by the Producer and its assigns for the purposes of relaying information regarding the status of Registrant’s entry, as well as general information pertaining to The Cleveland Oktoberfest, The Cleveland Oktoberfest Car Show, and future iterations of these annual events.
